I am a mother of 6 with one on the way.  My husband and I each had two children of our own when we married, and we now resemble a modern day Brady bunch.  However, due to the blended family situation we have encountered child support situations and many lawsuits for custody modifications.  Needless to say we have been blessed and have all of the kids in our care.  I live in the Dallas area so knowing child support laws in my state are important and allow me to be informed.  First of all if he has a job all you have to do is contact your state&#039;s office of the attorney general child support division and see what they can do.  I have found that constant phone calls and emails to their office often get a rapid response.  If they do nothing to help see if contacting the Texas office of the attorney general will help.  If you are not concerned about the support then you are more than willing to take him to court for a child custody modification.  If he pays CS or is supposed to then he has visitation rights and could at anytime sue you for custody especially if you do not allow him visitation.  In the state of Texas if the father is more than 6 months or more of support behind and has not seen or attempted to see the child in that time then it is considered abandonment.  At that time you can ask the court to terminate his rights and in most cases this will happen, but you will not receive the child support that he owes on behalf of y&#039;alls son.  Nor will you get any child support in the future.  If you were to ever remarry then your new husband could adopt your child with no problem and be on the birth certificate with a name change. Next, you need to take him to court. It doesn&#039;t matter that he is out of state. If he owes the child money, it is your responsibility to make sure that the boy gets his money. If he can&#039;t pay, he will go to jail. 

You may be able to work out a deal that if he signs his parental rights away, he doesn&#039;t have to pay the child support.
